TERMS OF SERVICE

These Terms of Service ("Agreement") govern the terms and conditions for the provision of the NUR mobile application and related services ("Service") by Huma Yazılım Anonim Şirketi ("Company") and the use thereof by users ("User", "You").
By downloading the application, creating an account, or otherwise availing yourself of the Service, you declare that you have read, understood, and accepted this Agreement together with its integral components — the Privacy Policy, KVKK Information Notice, and Explicit Consent document.

User: The natural person who uses the Service and creates an account on the NUR application.
2. DESCRIPTION OF THE SERVICE
NUR is a mobile application that offers features such as streaming of Islamic content including hymns, prayers, hadith, and Quran recitations, prayer time calculation, qibla direction, dhikr counter, and social Dhikr Rooms. The Company reserves the right to unilaterally update, add, remove, or modify the features within the scope of the Service.
3. AGE REQUIREMENTS
3.1. To use NUR Services, you must be at least 13 years old for Turkey and at least 16 years old for European Union countries. Users below these ages may not use the Service.
3.2. Users between 13–18 years of age represent that they have obtained the consent of their parent or legal guardian to use the Service.
3.3. Age verification is conducted at registration via the "year of birth" field. Providing a false age declaration constitutes a breach of this Agreement, and the account shall be terminated immediately.
4. ACCOUNT CREATION AND SECURITY
4.1. Account creation methods: e-mail+password, Google Sign-in, Apple Sign-in.
4.2. The User is responsible for the accuracy, currency, and completeness of the information they declare.
4.3. The confidentiality of account access credentials (password, session token) is the responsibility of the User. The User is responsible for all consequences arising from account misuse.
4.4. Only one account may be created per User; if multi-account abuse is detected, the accounts shall be suspended.
5. INTELLECTUAL PROPERTY RIGHTS
5.1. Rights of the Company: All software, designs, trademarks, logos, text, sound recordings (produced or licensed by the Company), graphics, code, algorithms, database structure, and compilation rights (Sui Generis Database Right — FSEK Supplementary Art. 8) in the application belong to the Company or its licensors.
5.2. AI-Generated Content: The application may contain audio, visual, and text content produced or enhanced using artificial intelligence technologies. All commercial use, ownership, and database rights of such content belong to the Company; the User may not use, reproduce, or distribute such content outside the application.
5.3. Third-Party Content and Attributions (FSEK + DMCA equivalent):
Quran recitations: Obtained from MP3Quran.net (https://mp3quran.net) through publicly available data access protocols.
- Reciters offered: Abdul Rahman Al-Sudais, Mishary Rashid Alafasy, Saad al-Ghamdi, Maher al-Muaiqly, Ahmed Al-Ajmi (sample list)
- The text of the Holy Quran is universally in the Public Domain
- Recitation audios are distributed by MP3Quran.net within the scope of its free religious service
Hymns: Hymns in the traditional Ottoman/Turkish religious music repertoire are works in the public domain and are used to the extent that attribution is made. For hymns whose lyricist and composer are known, source attribution is provided. For modern licensed hymns, licenses obtained from the relevant artist/production company are retained.
Hadith and Prayer Sources: Compiled from the principal hadith sources (Sahih al-Bukhari, Sahih Muslim, Sunan al-Tirmidhi, etc.). For each hadith, the narrator, source (book, book-chapter-number), and degree of authenticity are displayed. The copyrights of Turkish translations belong to the relevant translator (e.g., the translation of the Presidency of Religious Affairs — usable for the purpose of public service).
Copyright Infringement Notice (DMCA / FSEK): If you believe that content displayed on NUR infringes copyright, for application:

destek@huma.ist(subject: "Copyright Infringement Notice") - A declaration that you are the copyright holder, a description of the work, the exact address of the infringement on NUR, your contact details, and a statement of liability for false declaration are required
- Preliminary response within 48 hours, takedown within 24 hours for valid applications
- Right of counter-notice by the content uploader (DMCA Sec. 512(g) equivalent) is granted
Safe Harbor: NUR operates with the status of a hosting provider for user-generated content within the framework of Article 9 of Law No. 6563 on Electronic Commerce and international safe harbor regulations (DMCA Sec. 512).
5.4. Prohibited Actions: Without the written consent of the Company, the User may not:
- Copy, reproduce, distribute, sell, or rent the Service or its contents.
- Reverse engineer, decompile, or disassemble the Service.
- Use the Service for automated data collection (scraping, bots, AI training).
- Export audio, visual, or text files contained in the application; or broadcast them via screen recording/mirroring.
- Bypass the security mechanisms of the Service (App Attest, FreeRASP, AppCheck).
6. USER-GENERATED CONTENT AND COMMUNITY RULES
In the NUR community, adherence to the fundamental principles of respect, Islamic decorum, truthfulness, and safety is expected.
6.1. Dhikr Room Rules
- Room creation: Room name and description are subject to moderation by the Company. Advertising, link spam, and promotion of non-religious content are prohibited. Do not use the names/titles of others without permission.
- Room administrator responsibility: The room creator/administrator is primarily responsible for the environment in the room; has the authority to remove participants who violate the rules from the room; admin transfer is possible.
- Participant behavior: Respect for other participants; spam, profanity, insult, statements degrading religious values are prohibited; posts involving political debate or sectarian conflict are not appropriate.
- Automated content moderation: The Company may apply AI-based content moderation to prevent abuse (Gemini 2.0 Flash + additional layers — title-content consistency, profanity, Islamic appropriateness check).
6.2. Prohibited Content and Behaviors
Illegal content:
- Encouragement / promotion of acts constituting a crime
- Content inciting violence, discrimination, or hate speech
- Child abuse, obscene, or sexual content
- Terrorist organization propaganda
Content contrary to religious sensitivities:
- Statements insulting Islam or other religions
- Content fueling sectarian conflict
- Content distorting or misrepresenting religious rulings
- Promotion of practices that may be considered bid'ah or superstition
Other prohibitions:
- Spam, commercial promotion, multi-accounting, use of bots
- Sharing personal data of others without permission (doxxing)
- Account sale, account sharing, copyright infringement
- Bypassing the security mechanisms of the Service, automated requests/attacks (DDoS, rate limit bypass)
6.3. Complaint and Reporting Mechanism
Complaint channels:
- In-app "Report" button: instant notification for a room or user that violates the rules

destek@huma.ist - Emergencies (sexual abuse, terrorism, suicide threat): direct e-mail + notification to competent authorities
Complaint review process:
- A preliminary review is conducted within 48 hours of receiving the complaint
- Automated checks (audit log, content history) are run on the reported user
- A decision is made: warning, temporary suspension, permanent termination, or rejection of the complaint
- The complaining user is informed of the decision
Blocking: A User can block another user — in this case, the other user will not appear in the same room with you, cannot invite you / interact with you.
6.4. Sanctions

The Company reserves the right to proceed directly to severe sanctions depending on the nature of the violation.
6.5. Right to Appeal
- After an account suspension/termination notice, an appeal e-mail may be sent to
destek@huma.istwithin 30 days to request a review reiteration - The appeal review is conducted by a team independent of the team that issued the initial decision

6.6. Platform Liability
The Company makes reasonable efforts to enforce the Community Rules; however, it is not obliged to perform real-time monitoring of all user-generated content. The Service is operated in accordance with the hosting provider status within the scope of the Turkish Code of Obligations (TBK) and the Industrial Property Code.
7. PREMIUM SUBSCRIPTION AND PAYMENTS
7.1. NUR is offered at two subscription tiers: free and Premium. Details are set out in the Subscription Agreement document.
7.2. The subscription auto-renews; unless canceled through store settings at least 24 hours before the end of the current period, the subscription will automatically renew for the same duration and price.
7.3. Payments are processed through the Apple App Store or Google Play Store; the Company does not directly access your bank/credit card information.
7.4. Refund Policy: Refunds are subject to the rules of the Apple App Store / Google Play Store. The Company does not have the authority to grant direct refunds outside the store. To request a refund through the store, you must contact the relevant store support.
7.5. Invite Reward: 30 days of Premium may be granted as a gift for every 10 successful invites. The Company reserves the right to modify or terminate the invite reward program.
8. SUSPENSION AND TERMINATION OF THE SERVICE
8.1. Termination by the User: You may delete your account at any time via the "Profile > Delete My Account" menu. Details are provided in the Privacy Policy and Data Retention Policy.
8.2. Termination by the Company: The Company may terminate the Agreement in the following cases:
- Material breach of this Agreement or the Community Rules
- Unlawful use, fraud, or payment fraud
- Behavior that endangers the technical infrastructure of the Service
- Account multiplication or use of bots
8.3. In the event of termination, refunds for the remaining days of paid premium periods are subject to Apple/Google store rules.
9. LIMITATION OF LIABILITY
9.1. The Service is provided "AS IS" and "AS AVAILABLE".
9.2. The Company does not warrant that the Service will operate uninterrupted, error-free, virus-free, or fit for any particular purpose.
9.3. Accuracy of Religious Content: Prayer times, qibla direction, and religious content provided in the application are obtained from third-party sources and algorithms. Official religious reference shall be based on the records of the Presidency of Religious Affairs (Diyanet İşleri Başkanlığı); the Company cannot be held liable for any possible deviations in such content.
9.4. The Company's total liability shall not exceed the total fee paid by the User for the Service within the last 12 months.
9.5. The Company shall not be liable for any indirect, incidental, special, punitive, or consequential damages (loss of profit, loss of data, reputational damage, etc.).
10. INDEMNIFICATION
The User agrees to indemnify the Company for all lawsuits, claims, damages, penalties, costs, and attorney's fees incurred by the Company due to the User's breach of this Agreement.
11. GOVERNING LAW AND COMPETENT COURT
11.1. This Agreement is governed by the laws of the Republic of Türkiye.
11.2. The Istanbul (Çağlayan) Courts and Enforcement Offices shall have exclusive jurisdiction over any disputes arising from this Agreement or use of the Service.
11.3. For Users who qualify as consumers, the competent consumer courts and consumer arbitration committees under Law No. 6502 on Consumer Protection (TKHK) are reserved.
12. ELECTRONIC COMMUNICATION
The User accepts that the Company may deliver notices under this Agreement and transactional communications relating to the Service (account verification, subscription renewal, security alerts, etc.) via e-mail or in-app notifications.
13. AMENDMENTS
13.1. The Company reserves the right to unilaterally update this Agreement.
13.2. In the case of material changes, the User will be informed via a re-consent modal upon application launch. If you do not re-consent, you may not continue to benefit from the Service; however, your right to delete your account and export your data is reserved.
14. MISCELLANEOUS PROVISIONS
14.1. Entirety: This Agreement, together with the Privacy Policy, KVKK Information Notice, Explicit Consent document, Subscription Agreement, and other legal documents, constitutes the entire agreement between the parties.
14.2. Severability: The invalidity of any provision shall not affect the validity of the other provisions.
14.3. Non-Assignment: The User may not assign their rights and obligations under the Agreement without the written consent of the Company. The Company may assign the Agreement to its affiliates, assignees, or legal successors.
14.4. Language: The Turkish text of this Agreement shall prevail. English and Arabic translations are provided for informational purposes; in case of any dispute, the Turkish text shall govern.
