SUBSCRIPTION AGREEMENT (PREMIUM)

This Subscription Agreement ("Subscription Agreement") governs the conditions for the purchase, performance, and termination of the NUR Premium subscription service offered by Huma Yazılım Anonim Şirketi ("Company", "NUR").
This document has been prepared to satisfy the requirements of the Consumer Protection Law No. 6502 (TKHK), the Distance Contracts Regulation under TKHK Art. 49, Apple App Store Review Guidelines 3.1.2 (Subscriptions), and the Google Play Subscription Policy.
1. PARTIES
SELLER: Huma Yazılım Anonim Şirketi (full Company details are set out in the Terms of Service).
BUYER (CONSUMER): The User who purchases the NUR Premium subscription.
2. SUBJECT MATTER OF THE SUBSCRIPTION SERVICE
The NUR Premium subscription includes the following additional features:
- Ad-free experience: AdMob advertisements are not displayed
- High-quality (HD) audio streaming
- Offline downloads: download hymns, prayers, and Quran recitations to your device for offline listening
- Permission to create Dhikr Rooms
- Premium religious content collections
- Priority support
The Company reserves the right to add, remove, or modify features within the scope of Premium; in case of material changes, the Subscriber will be informed in advance.
3. SUBSCRIPTION TERM AND PRICE
3.1. The subscription term and pricing are clearly displayed on the in-app paywall screen and on the relevant store (App Store / Play Store).
3.2. Typical subscription terms: monthly (1 month), yearly (12 months). Specific plan names, prices, and terms depend on the store listing.
3.3. Prices may be changed by the Company; before applying a price change to existing subscriptions, the Subscriber will be notified in advance by e-mail and in-app notification.
4. AUTO-RENEWAL
4.1. The subscription renews automatically.
4.2. Unless canceled through store settings at least 24 hours before the end of the renewal period, the subscription will automatically renew for the same duration at the applicable price for the next period.
4.3. The fee is charged to the payment method registered with the store within the last 24 hours of the period.
4.4. If a promotion/discount applies on the date of renewal, the renewal shall be made at the standard list price (unless expressly stated otherwise).
5. FREE TRIAL PERIOD (IF APPLICABLE)
5.1. Certain subscription plans may include a free trial period; duration and conditions are clearly displayed on the paywall screen.
5.2. Unless canceled through the store at least 24 hours before the end of the free trial period, the trial will automatically convert into a paid subscription.
5.3. Users who have previously benefited from a free trial cannot benefit from another trial period (Apple/Google policy).
6. PAYMENT METHOD AND BILLING
6.1. All payments are processed through the Apple App Store (iOS) or Google Play Store (Android). The Company does not directly access your bank/credit card information; payment processing is provided entirely by the relevant store.
6.2. Receipts issued by the store qualify as legal invoices. The Company has no obligation to issue an additional invoice.
6.3. The RevenueCat infrastructure is used for subscription state management; no payment information is processed via RevenueCat — only transaction identifiers and subscription state data are managed.
7. RIGHT OF WITHDRAWAL (TKHK Art. 48 — Distance Contracts)
7.1. Exception to the Right of Withdrawal: Pursuant to Article 15/1(ğ) of the Distance Contracts Regulation under TKHK, "services performed electronically and instantaneously, or intangible goods delivered instantaneously to the consumer" are excluded from the scope of the right of withdrawal. Since the NUR Premium subscription falls within this scope, the 14-day right of withdrawal does not apply once the subscription is initiated.
7.2. Notwithstanding:
- Apple App Store users may apply directly to Apple for a refund within 90 days of purchase (evaluated at Apple's discretion).
- Google Play Store users may receive an automatic refund through Google within 48 hours of purchase.
7.3. The Company does not have the authority to grant direct refunds outside the store.
8. CANCELING THE SUBSCRIPTION
8.1. On iOS Devices (Apple App Store)
- Open the Settings app
- Tap your name → Subscriptions
- Select the NUR subscription
- Tap Cancel Subscription
8.2. On Android Devices (Google Play Store)
- Open the Google Play Store app
- Profile icon → Payments and subscriptions → Subscriptions
- Select the NUR subscription
- Tap Cancel subscription
8.3. Effect of Cancellation
After cancellation, you may continue to enjoy Premium features until the end of the current period; thereafter the subscription will automatically revert to the free plan. If the subscription is canceled in the middle of its term, no refund will be issued for the remaining days (store policy).
9. PREMIUM GIFT: INVITE REWARD
9.1. 30 days of NUR Premium are granted as a gift in exchange for 10 successful invites.
9.2. The invite-reward Premium does not stack with purchased Premium; the invite-reward period is appended to the end of the current subscription.
9.3. The Company reserves the right to modify, restrict, or terminate the invite reward program; such modification shall not have retroactive effect.
10. TERMINATION OF THE SUBSCRIPTION BY THE COMPANY
This Agreement falls within the scope of Article 8 (Termination of Account) of the Terms of Service. In the case of account termination, refunds for the remaining subscription period shall be subject to Apple/Google store policies.
11. GOVERNING LAW AND DISPUTES
11.1. This Agreement is governed by the laws of the Republic of Türkiye.
11.2. For disputes within the monetary limits of the Consumer Arbitration Committees, the relevant consumer arbitration committees shall have jurisdiction.
11.3. For disputes exceeding those limits, the Consumer Courts at the Consumer's place of residence or the Istanbul Consumer Courts shall have jurisdiction.
